Essential Fish Habitat


Amendments to the Magnuson-Stevens Fishery Conservation and Management Act, approved by Congress in 1996, included provisions for the description, identification, conservation, and enhancement of Essential Fish Habitat (EFH). Included in the Magnuson-Stevens amendments is a deadline to have all EFH amendments to fishery management plans (FMP) under the federal Fishery Management Councils submitted to the Secretary of Commerce by October 11, 1998.

While the Magnuson-Stevens amendments specify that EFH provisions apply only to fish populations under federal management, they also indicate that the EFH provisions apply to all life stages of those fish populations. In many cases, various life stages of fish under federal management require habitats that are located in state jurisdictions; consequently, state agencies charged with management of fish and the environment within their jurisdictional boundaries have a vested interest in the designation of EFH.
